Terms & Acceptable Use Policy

1. Eligibility & Accounts

You may use IbroArt AI only if you are legally allowed to enter into a binding agreement in your country or region. Users below the legal age of consent in their location may only use the platform with the consent and supervision of a parent or legal guardian.

To use some features you may need to create an account, log in through WhatsApp, email, phone number, Google, or another supported method. You are responsible for keeping your login details secure, ensuring your account information is accurate, and all activity that happens under your account. You must not sell, transfer, share, or misuse another person's account.

We may restrict, suspend, or terminate access where we believe a user is underage, misusing the platform, or violating this policy.

2. Image Upload & Prompt Rules

By uploading an image, you confirm that:

• The image belongs to you, shows you, or you have permission from the person in the image.
• You are not uploading another person's photo without their consent.
• You are not attempting to impersonate, embarrass, harass, sexualize, defame, or misrepresent another person.
• The image does not contain nudity, sexually explicit content, sexual poses, sexualized minors, abuse, violence, hate symbols, or illegal activity.
• The image does not violate any copyright, trademark, privacy, or other third-party right.

Text prompts must not be sexual, abusive, threatening, hateful, discriminatory, intended to exploit or endanger minors, impersonate or deceive others, promote violence or illegal activity, or designed to bypass our safety systems.

We may automatically reject, block, or report content that appears to involve identity misuse, non-consensual image use, impersonation, or harmful deepfake-style generation.

3. Prohibited Content

You must not use IbroArt AI to upload, create, generate, edit, share, request, or distribute content that includes or promotes:

• Sexual or adult content — nudity, pornography, sexualized images of real people without consent, sexual deepfakes, or any sexual content involving minors or anyone who appears to be a minor.
• Abuse, harassment, and hate — threats, bullying, humiliation, or content attacking people based on race, ethnicity, religion, nationality, gender, disability, age, or sexual orientation.
• Violence, harm, and illegal activity — graphic violence, criminal instructions, terrorist or extremist content, scams, fraud, or phishing.
• Identity misuse and deception— using another person's image without permission, fake endorsements, or misleading people into believing AI-generated content is a real photograph or event.
• Intellectual property violations — copyrighted images, protected logos or characters, or content falsely suggesting sponsorship or endorsement.

4. AI-Generated Content

IbroArt AI uses artificial intelligence to create or modify images based on your uploads and prompts. Results may not always be accurate, realistic, or suitable for every use — they may contain errors, distortions, or unexpected visual changes. Generated content should be reviewed before being posted, printed, shared, or used commercially.

We do not guarantee that generated content will be unique, copyright-free, or suitable for commercial use. You must not misrepresent AI-generated images as real photographs, real events, official documents, or verified identity materials where doing so may deceive or harm others.

5. Ownership & License

You retain ownership of the images, text, and other materials you upload, subject to any rights held by third parties. By uploading content, you grant IbroArt AI a limited license to process, store, transform, generate, display, and deliver outputs from that content for the purpose of providing the service.

Subject to this policy, payment status, third-party rights, and applicable law, you may use generated outputs for personal, social, business, or promotional purposes — but you are responsible for ensuring your output does not violate another person's rights, privacy, or applicable law.

We will not publicly post your private uploads as marketing materials without your permission. Where you voluntarily share generated content publicly or submit it for showcase, we may request permission to feature it in marketing or platform galleries.

6. Credits, Payments & Refunds

• Credits are consumed once a generation request is processed, and are not refundable once used, except where required by law or where we confirm a technical failure.
• Credits may have expiry periods if clearly stated at purchase.
• Credits must not be resold, transferred, manipulated, or obtained fraudulently.
• Payments are processed securely via Paystack — we do not save, store, or view your payment card details.
• We reserve the right to reverse fraudulent transactions, suspend suspicious accounts, or block access where payment abuse is detected.

7. Content Review & Enforcement

We may use automated systems, human review, third-party moderation tools, and provider-level safety checks to detect unsafe or prohibited content. Where content or account activity violates this policy, we may:

• Reject prompts or uploads, or block image generation.
• Remove content, warn the user, or restrict access to credits or features.
• Suspend or terminate an account.
• Report serious illegal or harmful activity to appropriate authorities where required by law.

8. WhatsApp & Third-Party Channels

IbroArt AI may be available through WhatsApp, web, mobile, or other third-party channels. When using IbroArt AI through a third-party platform, you may also be subject to that platform's own terms and policies. We may send transactional, service, account, payment, or support messages where permitted. You must not use IbroArt AI through any channel to send spam, abusive content, adult content, scams, or illegal material.

9. Service Availability & Disclaimer

We may update, improve, pause, limit, or discontinue parts of the service at any time. We do not guarantee that the service will always be available, error-free, uninterrupted, or that every generation request will produce the exact desired result.

IbroArt AI is provided on an "as is" and "as available" basis and is a creative tool — it should not be used to create official identity documents, legal evidence, medical advice, financial advice, political deception, or any content intended to mislead people in serious contexts.

10. Liability & Indemnity

To the maximum extent permitted by law, IbroArt AI, Topibro Technologies Limited, its team, partners, providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or reputational damages arising from your use or inability to use the service. You are responsible for your uploads, prompts, generated outputs, and how you use or share them.

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, costs, or expenses arising from your use of the platform, your uploaded content or prompts, your violation of this policy, or your violation of another person's rights or applicable law.

11. Suspension & Termination

We may suspend, restrict, or terminate your access if we believe you violated this policy, uploaded or requested unsafe content, misused another person's image, engaged in fraud, abuse, spam, or illegal activity, or that your activity creates risk for users, the platform, providers, or the public. In serious cases, we may permanently ban the account and preserve relevant records where needed for safety, fraud prevention, or legal compliance.

12. Reporting Violations

You may report content, accounts, generated images, or behavior that violates this policy — including non-consensual image use, impersonation, sexual or abusive content, harassment, copyright or trademark complaints, fraud, spam, or illegal activity.

13. Updates to This Policy

We may update this Terms & Acceptable Use Policy from time to time. The updated version will be posted with a new "Last updated" date. Your continued use of IbroArt AI after updates means you accept the revised policy.
